RANCHI, India, Oct. 9 -- Jharkhand High Court issued the following order on Sept. 9:

1. Heard learned senior counsel appearing on behalf of Petitioner and learned APP appearing on behalf of the State.

2. The petitioner is apprehending his arrest in connection with Barwadda P.S. Case No.181 of 2025, for the alleged offences registered under Sections 303(2), 317(5) and 3(5) of the BNS, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Dhanbad.

3. Learned senior counsel appearing for the petitioner submits that 10 ton of coal was loaded in one of the trucks and the petitioner is neither the owner nor the driver of the said truck and he is the director of a company namely Ganesh Laxmi Properties Private Limited, wherein the mineral waters are being prepared and false allegation has been made against the petitioner. He further submits that the petitioner has also replied the notice issued under Section 35(3) of BNSS.

4. Learned counsel for the State opposed the prayer and submits that illegally coal was loaded.

5. In view thereof and considering the petitioner has got no criminal antecedent and it is pointed out that the petitioner is neither the owner nor the driver of the vehicle in question and false allegations has been made out for carrying out of 10 tons of coal and the petitioner has replied the notice issued under Section 35(3) of BNSS, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition or sureties, the learned Court may deem fit and proper.

6. This Anticipatory Bail Application is accordingly disposed of.
