RANCHI, India, Dec. 25 -- Jharkhand High Court issued the following order on Nov. 25:
This appeal is directed against the order dated 25.08.2025 passed by learned Additional Judicial Commissioner-XVII, Ranchi in Misc. Criminal Application No.1672 of 2025 in connection with S.T. No.516 of 2025 arising out of Bariyatu P.S. Case No.63 of 2025 corresponding to G.R. No.1683 of 2025, whereby and whereunder prayer for bail of the appellant has been rejected.
It has been alleged that when the informant and his bodyguard were travelling on a vehicle, two miscreants had opened fire, as a result of which, the informant suffered fire-arm injuries on his neck and hand. The bodyguard of the informant had retaliated after which the miscreants had fled away.
Submission has been advanced by the learned counsel for the appellant that the appellant is not named in the First Information Report and has been implicated on his self-confession as well as the confession of Vishal Kumar Munda @ Vishal Munda and Prem Pandey. Learned counsel submits that Vishal Kumar Munda @ Vishal Munda and Prem Pandey have been granted bail by this Court in Cr. Appeal (D.B.) No.1148 of 2025 and Cr. Appeal (D.B.) No.943 of 2025. It has been submitted that the appellant is in custody since 18.03.2025 and no incriminating article was recovered from his possession.
Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed the aforesaid facts.
Regard being had to the above facts, we while setting aside the order dated 25.08.2025 passed in Misc. Criminal Application No.1672 of 2025 in connection with S.T. No.516 of 2025 arising out of Bariyatu P.S. Case No.63 of 2025 corresponding to G.R. No.1683 of 2025 by the learned Additional Judicial Commissioner-XVII, Ranchi, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below.
This appeal is allowed.
