RANCHI, India, Oct. 16 -- Jharkhand High Court issued the following order on Sept. 15:
1. Heard Mr. Raja Ravi S. Singh, learned counsel for the appellant and Mr. Vishwanath Roy, learned Spl.P.P. appearing for the State.
2. This appeal is directed against the order dated 26.04.2025 passed by the learned Additional Sessions Judge-I, Rajmahal in connection with B.P. No. 68 of 2025 arising out of Tinpahar P.S. Case No. 07 of 2025, whereby and whereunder the prayer for bail of the appellant has been rejected.
3. It has been alleged that the appellant was taking three children to Delhi on the allurement of money and new clothes and those three children were subsequently recovered.
4. Submission has been advanced by the learned counsel for the appellant that the appellant does not have any criminal antecedent and he is in custody since 06.02.2025. It has further been submitted that all the children have been recovered.
5. Mr. Vishwanath Roy, learned Spl. P.P. appearing for the State has opposed the prayer for bail of the appellant but has not disputed the fact that the appellant does not have any criminal antecedent.
6. Regard being had to the above, we while setting aside the order dated 26.04.2025 passed by the learned Additional Sessions Judge-I, Rajmahal in connection with B.P. No. 68 of 2025 arising out of Tinpahar P.S. Case No. 07 of 2025, direct the appellant to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount, to the satisfaction of learned Addl. Sessions Judge-1 ST Class, Rajmahal.
7. Accordingly, this appeal stands allowed and disposed of.
