RANCHI, India, Jan. 27 -- Jharkhand High Court issued the following order on Jan. 5:

Heard Mr. Anurag Kashyap, learned counsel for the appellant and learned Spl. P.P. for the State.

This appeal is directed against the order dated 01.11.2025 passed in Misc. Criminal Application No. 2549/ 2025, arising out of Hariharganj P.S. Case No. 40/2013, corresponding to G.R. Case No. 644/2013 (S.T. Case No. 88/2019), by the learned Additional Sessions Judge-VIII, Palamau at Daltonganj, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that there was an exchange of firing between the Police personnel and the extremists who had also blasted Pipra Block Office and the FCI godown.

Submission has been advanced by the learned counsel for the appellant that the appellant is not named in the First Information Report and his name has subsequently transpired on the confessional statement of the co-accused. Learned counsel further submits that on account of the said fact the appellant was not aware about he having been implicated in a case and on coming to know about the same the appellant had surrendered on 20.08.2025. It has been submitted that some of the coaccused persons have been granted bail by this Court in B.A. No. 2283 of 2019 and B.A. No. 5711 of 2021.

Learned Spl. P.P. for the State has opposed the prayer for bail of the appellant.

On consideration of the manner of implication of the appellant and the fact that some one of the co-accused persons have been granted bail as noted above, we while setting aside the order dated 01.11.2025 passed in Misc. Criminal Application No. 2549/2025, arising out of Hariharganj P.S. Case No. 40/2013, corresponding to G.R. Case No. 644/2013 (S.T. Case No. 88/2019), by the learned Additional Sessions Judge-VIII, Palamau at Daltonganj, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VIII, Palamau at Daltonganj in S.T. Case No. 88/2019, arising out of Hariharganj P.S. Case No. 40/2013, corresponding to G.R. Case No. 644/2013, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient reasons.

This appeal stands allowed.
