The present applicant, Anshul Jagwan, son of Hayat Singh Jagwan, seeks regular bail in connection with FIR No. 0020 of 2026 dated 18.04.2026, registered under Sections 351(2), 351(3), 64(1) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3 and 4 of the POCSO Act at Police Station Augustyamuni, District Rudraprayag.

4. Learned counsel for the applicant submits that the applicant is innocent, has been falsely implicated, and that the charge sheet has been filed mechanically. It is further submitted that the medical report does not support the prosecution case. The FIR does not disclose the exact date of the alleged occurrence and is based only on oral allegations. It is also submitted that the victim's parents had earlier lodged a missing complaint, which has been suppressed in the FIR. According to the applicant, the victim's actual date of birth is 01.01.2008 and she was above 18 years of age on the date of the alleged incident. In support of this, a document issued by the Government Primary Health Centre has been filed as Annexure No. 3. It is further submitted that the applicant has been in judicial custody since 19.04.2026 and that the medical report records no external injury or sign of sexual assault on the victim.

5. Learned State Counsel does not dispute that the medical report records no external injury or sign of sexual assault on the victim and also contains no reference regarding the hymen.

6. After hearing learned counsel for the parties and considering that the medical report does not indicate any sign of sexual assault on the victim, this Court is of the view that the applicant deserves to be released on bail.

7. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed.

8. Let the applicant, Anshul Jagwan, son of Hayat Singh Jagwan, be released on bail on furnishing a personal bond and two sureties of the like amount to the satisfaction of the court concerned.
