1. This I.A. has been filed with the following prayer:-

"It is therefore humbly prayed that this Hon'ble Court may be pleased to

a. allow the Plaintiff to withdraw the suit.

b. Pass appropriate orders directing release of the Defendant Vessel lying at Paradip Port, Paradip.

c. Pass any such other and further Order(s), Direction(s) as this Hon'ble Court may deem fit in the interest of the justice;

For this act of kindness, the Appellant shall as in duty bound, ever pray."

2. By order dated 11.05.2026, this case had been taken up on special notice and notice had been issued to the Defendant by e-mail and courier and the case posted to 20.05.2026. I.A. No. 12 of 2026 seeking time to pay the deficit Court fee of Rs.11,11,935/- was allowed and payment of deficit Court fee had been dispensed with for the time being. In I.A. No. 11 of 2026, this Court, as an interim measure, awaiting receipt of the response of the defendant, had directed that the vessel in question shall be arrested.

3. There is nothing on record that notice has been served on the defendant by courier.

4. On 20.05.2026, the case was adjourned to 01.07.2026.

5. This I.A. filed for withdrawal of the suit was taken up on 29.05.2026 and the Plaintiff was directed to take notice on the Defendant through e-mail and had been granted liberty to move the Vacation Court for suitable direction after service of notice on the Defendant.

6. Mr. Ishwar Mohanty, learned counsel for the Petitioner has filed a memo along with a copy of e-mail dated 08.06.2026 addressed to unity@fmtcship.ae and info@fmtcship.ae stating that the copy of the application for withdrawal of proceedings filed in the captioned matter is served upon them.

7. It is apparent that till date the deficit Court fee has not been paid.

8. Hence list this I.A. before the assigned Bench on 23.06.2026.
