Heard Mr. A.K. Bhuyan, learned Sr. counsel along with Mr. H. Kalita and Mr. S. Chowdhury, learned counsel for the petitioner, who has submitted that her husband, Shri. Dip Hazarika, who is an accused, was detained on 12.06.2026 and was later shown arrested on 13.06.2026 in connection with Tura P.S. Case No. 70 of 2026 under Section 336(2)(3)/318(4)/338/111(2)(b) BNS, 2023.
It is also the submission of the learned Sr. counsel that the detention is totally illegal, the relevant provision of law being flouted, and as such, the whole process of his detention being illegal, is accordingly entitled to be enlarged on bail.
At this juncture, Mr. R. Gurung, learned GA appearing for the State respondent has made a prayer that the case diary may be called for to enable this Court to peruse the same so as to know the procedure that was carried out by the arresting authorities.
Accordingly, as prayed for, the prosecution is directed to produce copy of the case diary on the next date fixed.
As agreed to by the parties, list this matter on 06.07.2026.
