Heard Mr. S. Choudhary, learned counsel for the petitioner, who has submitted that the applicant herein has preferred this application on behalf of her husband Dip Hazarika, who was arrested in connection with Tura P.S. Case No. 70/2026 under Sections 336(2)/336(3)/318(4)/338/111(2)(b) of the BNS, 2023 and is still in judicial custody till date.

The learned counsel has, however, submitted that there is a forwarding report filed by the IO before the Court of the Chief Judicial Magistrate, West Garo Hills, Tura, wherein it has been indicated that the accused/husband of the petitioner, is also required to be questioned in connection with three other cases namely Tura P.S. Case No. 79/2024 under Section 468 IPC, Tura P.S. Case No. 87/2024 under Sections 336(2)/336(3)/340(2)/353(1) BNS, 2023 and Tura P.S. Case No. 83/2024 under Sections 468/417/418/419/420 IPC respectively. Apprehending arrest in connection with the said three cases, the petitioner has accordingly approached this court with this instant petition with a prayer for grant of anticipatory bail.

Mr. S. Sengupta, learned Addl. PP. has submitted that the IO may be directed to file the case diary as well as this status report, particularly as far as the role of the accused in question is concerned, as to whether he is indeed required to be questioned in the three abovementioned cases.

This Court on consideration of submission made, at this juncture, would allow the prayer made by the learned Addl. PP. The respective IO of the three abovementioned cases including this instant case, is hereby directed to produce the copy of the case diary as well as the status report qua the accused person in question on the next date fixed.

Accordingly, list this matter on 7th July, 2026.
