[1] Mr. T. Momo, learned Senior Advocate instructed by Mr. Dayali Elangbam, learned counsel on record for the sole revision petitioner is before this Court (physical Court) and learned senior counsel is ready to advance arguments.
[2] Mr. A. Golly, learned counsel on record for respondent No. 4, who is sailing with revision petitioner is also before this Court (physical Court) and he is also ready.
[3] However, Mr. L. Seityandra, learned counsel on record for respondent Nos. 2 & 3 who is before this Court on the Video Conferencing (V.C.) platform, requests for a short accommodation.
[4] Be that as it may, to be noted, respondent No. 1 (R1) died on 27.09.2022 {pending captioned Civil Revision Petition (CRP) which was filed on 17.12.2019} and in and vide order dated 30.01.2023 made in MC(CRP(CRP.Art.227)) No. 59 of 2022, 5 Legal Representatives(LRs) of deceased
R1 were brought on record but there is an earlier judicial order dated 30.01.2023 made by Hon'ble predecessor Chief Justice to the effect that legal heirs of deceased R1 are not interested in contesting the matter. This 30.01.2023 order reads as follows:
'30-01-2023
By way of this miscellaneous case, the petitioner in the CRP seeks substitution of the legal representatives of deceased respondent No. 1.
Notice having been ordered and served upon the proposed legal representatives, no one appears for them.
Mr. L. Seityandra, learned counsel, appearing for respondent Nos. 2 & 3, states on instructions from his clients that the said LRs are not interested in contesting this matter.
MC(CRP(CRP Art.227)) No. 59 of 2022 is accordingly ordered.
Registry is directed to carry out necessary corrections in the cause title of the main case.'
Therefore, legal heirs of deceased R1 are set ex-parte.
[5] Owing to the request of Mr. L. Seityandra, learned counsel on record for respondent Nos. 2 & 3, list tomorrow.
