Heard Mr.N.Jotendro, learned senior counsel assisted by Mr.Abdul Baqee Khan, learned counsel for the petitioner, Mr.Th.Vasum, learned Government Advocate on behalf of respondent Nos.1 and 2, Mr.Y.Nirmolchand, learned senior counsel assisted by Mr.Y.Nikhil, learned counsel on behalf of respondent No.3.

Mr.N.Ibotombi, learned senior counsel for respondent No.4 submits that respondent No.4 has filed Caveat Petn No.77 of 2026. However, the same is not listed today.

Caveat Petition is discharged.

Mr.N.Jotendro, learned senior counsel for the petitioner submits that petitioner applied for post of Controller of Examination in the Council of Higher Secondary, Manipur (COHSEM) in pursuance of Advertisement dated 2.12.2025 and eligibility criteria is 20 years' service in teaching with at least five years' experience of conducting Public Examinations in supervisory capacity. However, it is alleged that by the impugned order, State respondent has appointed private respondent No.4 as Controller of Examination, but at the same time respondent No.4 does not satisfy the eligibility criteria.

Issue Notice.

Mr.Th.Vasum, learned Government Advocate accepts notice on behalf of respondent Nos.1 and 2, Mr.Y.Nikhil, learned counsel assisting Mr.Y.Nirmolchand, learned senior counsel accepts notice on behalf of respondent No.3 and Ms.Y.Jinita, learned counsel assisting Mr.N.Ibotombi, learned senior counsel accepts notice on behalf of respondent No.4. Hence service is complete on respondents.

Learned counsel for respondents pray for two weeks' time for filing counter affidavit.

Mr.N.Jotendro, learned senior counsel for petitioner prays for stay of the impugned appointment order dated 25.6.2026 issued by the Joint Secretary, Education (S), Government of Manipur appointing respondent No.4 as Controller of Examination (COHSEM) for a period of three years on deputation. Learned senior counsel relies on Annexure A/6 (Employee Profile of respondent No.4).

Mr.N.Ibotombi, learned senior counsel for respondent No.4 opposed the prayer on the ground that no specific material is placed before this Court stating respondent No.4 is not eligible.

In the circumstance, prayer for interim order will be considered on filing of counter affidavit by respondents.
