Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. Petitioner seeks quashing of the order of cognizance dated 29.11.2022 passed in connection with Nawanagar P.S. Case No. 476 of 2021, G.R. No. 2905 of 2021 by which, the learned C.J.M., Buxar has taken cognizance of the offence under Section(s) 420, 467, 468, 471 & 120B of the Indian Penal Code.

The prosecution case is that the informant, Meena Kumari, Child Development Project Officer, Navanagar, Buxar, lodged a written application alleging that Tanuja Ray, wife of Pintu Kumar Singh, obtained the post of Anganbari Sevika (Code-178, Panchayat Girdhar Baraon) by submitting a forged matriculation certificate. It is stated that as per government guidelines, educational certificates must be verified before payment of remuneration. Accordingly, the submitted certificate was sent for verification, and the Bihar School Examination Board declared it forged through official communications. On the basis of these findings, the FIR was instituted against the accused.

Learned counsel for the petitioner submits that petitioner had applied for selection on the post of Anganbari Sevika, Panchayat, Giridhar Barao, Ward No. 08, District- Buxar in the month of June, 2019 and she has submitted her application form in the office of Child Development Project Officer, Nawanagar, Buxar, thereafter, along with application, the petitioner submitted all the relevant documents i.e. Matric Marksheet, Caste Residential Certificate etc., The petitioner has appeared in the Matric Examination conducted by the Bihar School Examination Board in the year 2014 and had obtained 261 marks and for selection to the post of Anganbari Secvika after the merit list of Anganbari Sevika Gram Panchayat- Girdhar Baraon was published, then the petitioner has made a representation to the Child Development Project Officer, Navanagar, Buxar on 03.07.2019 stating inter alia that a merit list for selection to the post of Anganbari Sevika was already published and in the merit
