1. Learned counsel for the appellant has submitted that this petition has been filed for substitution of deceased respondent No. 1, 6 and 8. He has submitted that the notice were issued to the proposed legal heirs of respondent No. 1 and 6 who have been served as per office note.

2. So far as respondent No. 8 is concerned he died issueless and his name is required to be deleted.

3. Notice upon proposed legal heir of respondent No. 1 and 6 has been served either personally or through their wife. He has submitted that the notice may be accepted as validly served.

4. Considering the submissions, the notice upon proposed legal heirs of respondent No. 1 and 6 are accepted as validly served.

5. Learned counsel for the appellant has submitted that there is a delay in filing the petition for substitution and he came to know about the death of the aforesaid respondent on 15.04.2025 when the service report was received. He has submitted that the delay may be condoned, abatement may be set aside and the substitution may be allowed.

6. Learned counsel for the State has not objection to the prayer for deletion of the name of respondent No. 8 and the prayer for substitution of respondent No. 1 and 6.

7. After hearing the learned counsel for the appellant and the State, the prayer for substitution of respondent No. 1 and 6 is allowed after condoning the delay and after setting aside abatement.

8. So far as respondent No. 8 is concerned, respondent No. 8 having died issueless, the name is required to be deleted.

9. I.A. No. 7287 of 2025 is hereby allowed.

10. Learned counsel for the appellant is directed to make necessary insertion in the cause title in 'red ink' during the course of the day.

I.A No. 1181 of 2025

11. Learned counsel for the petitioner has submitted that this petition has been filed seeking condonation of delay in filing the first appeal. He has submitted that notice was issued upon the respondent vide order dated 09.04.2025 and as per the records Vakalatnama to respondent No. 2 to 5, 7, 9 and 10 has already been filed.

12. However, so far as legal heir of respondent No. 1 and 6 are concerned, they have not been served notice on the point of limitation.

13. Considering the submission, let notice be issued to the legal heirs of respondent No. 1 and 6 on the point of limitation and also in the first appeal through the concerned police station for which requisites be filed within a period of one week.

14. Post this case on 31st July, 2026.
