I.A. No. 759 of 2024

1. This interlocutory application has been filed for stay of execution of the decree passed in Civil (Partition) Suit No. 04 of 2009 by the learned District Judge-III, Giridih.

2. Learned counsel for the appellant does not want to press this interlocutory application.

3. Accordingly, I.A. No. 759 of 2024 is hereby dismissed as not pressed.

I.A. No. 7333 of 2025

4. Learned counsel for the appellant submits that the husband of the respondent no. 10 was a party in the suit and upon his death, his wife Rajmani Devi (respondent no. 10) and her children were substituted. However, Rajmani Devi died on 15.12.2021 during the pendency of the partition suit, which was not brought to the notice of the court. The learned counsel submits that the name of respondent no. 10 is only required to be deleted and her legal heirs are already on record as respondent nos. 11 to 16 and her entire estate is duly represented by the other legal heirs and successors who are already on record.

5. Learned counsel for the respondents has no objection, so far as the prayer for deletion of name of respondent no. 10 is concerned and it is not in dispute that the legal heirs and successors of respondent no. 10 are already on record.

6. Considering the submissions, I.A. No. 7333 of 2025 is hereby allowed.

7. Learned counsel for the appellant is directed to delete the name of respondent no. 10 from the cause title in red ink during the course of the day.

F.A. No. 09 of 2024

8. Learned counsel for the appellant prays for and is granted two weeks' time to take fresh steps for service of notice upon respondent nos. 8, 9, 15 and 16 at their present and correct address, for which requisites be filed through speed-post, failing which the present appeal shall stand dismissed as against respondent nos. 8, 9, 15 and 16 without any further reference to the Bench.

9. Office to track speed-post-delivery and prepare appropriate office note in connection with service of notice.

10. Post this case on 17th August 2026.
