Heard learned counsel Mr. A.K Talukdar for the applicants/appellants No. (1) Tairun Nesa Khatun, (2) Rejia Begum, (3) Piyara Begum, (4) Moni Begum, (5) Baby Begum, (6) Abdul Mukhit, (7) Abdul Muhit and (8) Minu Mia.
Heard learned counsel Mr. T Roy for the respondents (2) Sirajul Islam, (3) Sokoi Mia, (4) Akoi Mia, (5) Abdul Zabbar and (6) Muhibur Rahman @ Moyna Mia.
The applicants have filed who have filed this application under Order 22 Rule 3 of the C.P.C with prayer for substitution of legal heirs of plaintiff No. 2 Sirajul Islam and 4. Akoi Mia who have passed away on 13.08.2020 and 06.12.2020 respectively.
I have considered the submissions at the bar. Considering all aspects, this application is allowed and in place of respondent No. 2, who has passed away, the names of (a) Rezia Begum, (b) Mustaque Ahmed, (c) Mohim Ahmed, (d) Shamim Ahmed, (e) Baharul Islam, (f) Monuwara Begum and (g) Mamata Begum are to be substituted being legal heirs of respondent No. 2.
The names of (a) Farhana Begum, (b) Tazir Uddin, (c) Ali Hussain, (d) Masum Ahmed, (e) Yahair Hussain (f) Sultana Begom and (g) Shabana Begom are to be substituted in place of the deceased respondent No. 4.
In terms of the above observation, this Interlocutory Application stands disposed of.
The cause title to be amended, in respect of the substituted legal heirs of plaintiff No. 2. Sirajul Islam and 4. Akoi Mia.
