GUWAHATI, India, Nov. 8 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard Mr. M. K. Sharma, learned counsel for the accused applicants. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam.
2. The gist of the case is that an FIR has been registered before the Paltan Bazar Police Station alleging that the informant's husband, namely, Prince Goyal had induced the informant to go to a hotel and had sexual intercourse with her. It was alleged that the incident occurred when their divorce proceeding was still pending before the learned Principal Judge, Family Court No.2, Guwahati.
3. It was alleged in the FIR that the Informant got pregnant and later on, she had a miscarriage. It was further alleged that the family of her husband including the accused persons have been harassing her because of the pendency of the divorce case. It was also alleged in the FIR that though while entering in the hotel, the Informant's husband's name was recorded in the hotel register, later on, with the connivance of the hotel authorities, his name has been removed by inserting the name of one Md. Abdul and thereby, alleged that the husband tried to erase evidence of spending time with the Informant in the hotel. It was alleged that the husband as well as the accused persons were also involved in such activity and thereby, fabricated false evidence.
4. Learned counsel for the petitioners submits that they were no way involved in the instant case and the husband of the Informant has already been granted bail by this Court. He also submits that though the divorce proceeding is pending before the Family Court, the mother, brother-in-law and sister-in-law are no way involved in the alleged incident described in the FIR, whereas learned Additional Public Prosecutor submits that at this stage the bail may not be granted without perusing the Case Diary.

This Court has gone through the FIR as well as the other materials on record and after considering the whole facts in it's entirety has found that this is a fit case where the accused applicants should be allowed to go on interim prearrest bail. Therefore, the accused applicants are allowed to go on interim prearrest bail on furnishing of bail bond of Rs.30,000/- each with a surety of like amount subject to the satisfaction of the Investigating Authority.
6. The instant interim pre-arrest bail is granted, however, subject to the following conditions:
i. The accused applicants shall appear before the Investigating Officer within 7 (seven) days of passing of this order and in the event of their non-appearance before or on 16.10.2025, the interim order shall be deemed cancelled.
ii. The accused applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts in the case so as to dissuade him from disclosing such facts to the court or to any police officer;
iii. The accused applicants shall make themselves available before the Investigating Officer as and when they are called for by the Investigating Officer;
7. Call for the Case Diary.
8. List this matter on 01.11.2025.
