GUWAHATI, India, June 27 -- Gauhati High Court issued the following order on May 28:

The present application has been filed by the respondent claimants, for withdrawing 50 % of the award dated 08.08.2024, which has been deposited by the appellant insurance company in compliance with order dated 20.12.2024 passed in I. A. (Civil) 3983/2024 arising out of MAC Appeal 634/24.

Learned counsel, Mr. D. Mondal, submits that this Court vide order dated 20.12.2024 had stayed the operation of the Judgment and award dated 08.08.2024. passed by the learned Member, MACT No. 2, Kamrup(M), Guwahati in Mac Case No. 1956/2018, subject to the condition that the opposite party/ appellant shall deposit 50 % of the said award within a period of 4 weeks from the date of this order.

It is submitted that in compliance with the said order the insurance company/appellant has already deposited the 50 % of the award dated 08.08.2024 before the Registry of this Court on 20.01.2025.

Further, it is prayed that this amount may be allowed to be withdrawn by the claimants. The learned counsel, Mr. D. Mondal for the appellant insurance company is present and has not objections to the said prayer provided that the claimants execute an indemnity bond of like amount before the Registry.

Accordingly, this application is allowed.

The claimants/applicant is allowed to withdraw the said awarded amount on execution of indemnity bond of like amount.

Registry shall do the needful after proper verification.

The application stand disposed of.
