GUWAHATI, India, Sept. 25 -- Gauhati High Court issued the following order on Aug. 26:
Heard Mr. A. Deka, learned counsel for the petitioner and Ms. S. H. Bora, learned Addl. P.P., Assam for the State.
By this application filed under Section 482 of the BNSS, 2023 the petitioner, viz., Mustaquim Billah has prayed for pre-arrest bail in connection with CID P.S. Case No.15/2025 registered under Sections 61(2)/318(4)/336(3)/340(2) of the BNS.

Heard on the prayer for interim relief.
The F.I.R. dated 31.07.2025 reveals that during the recruitment process for graduate and post-graduate teachers under the Education Department, Assam the petitioner along with other candidates is alleged to have submitted fake pass certificates issued by Techno Global University, Madhya Pradesh.
Mr. A. Deka, learned counsel for the petitioner submits that the University mentioned in the F.I.R. is a genuine university and there was no possibility of issuing any fake certificate by the same. Mr. Deka has also placed the recognition order of the said University by the NCTE under the relevant Act.
Ms. S. H. Bora, learned Addl. P.P., however, submits that the fact of applying for jobs by giving fake certificate is a serious issue and the same needs investigation.
I have perused the materials available on record.
It is reflected in the F.I.R. that 50 candidates had submitted pass certificate which is stated to be fake issued by Techno Global University, Madhya Pradesh and amongst them the petitioner is stated to be one. It is also seen that the police have searched the house of the petitioner and the concerned certificates were seized from his house, the genuineness of which would be seen by the Investigating Officer during investigation. As such, it is deemed fit to release the petitioner on interim pre-arrest bail on furnishing a bail bond of Rs.20,000/- with one local surety to the satisfaction of the arresting authority under the following conditions :-
(1) That the petitioner shall appear before the Investigating Officer within 7 (seven) days from the date of this order and shall cooperate with the investigation.
(2) That the petitioner shall not tamper with the evidence and shall not influence the witnesses connected with the case.
(3) That the petitioner shall not leave jurisdiction of the concerned Police Station without the leave of the Investigating Officer.
