GAUHATI HIGH COURT ISSUES ORDER ON MS ELIZA SULTANA AND ANR V/S THE STATE OF ASSAM AND 4 ORS

GUWAHATI, India, Aug. 2 -- Gauhati High Court issued the following order on July 2:

Heard Mr. A.K. Talukdar, learned counsel for the applicants/writ petitioners. Also heard Ms. M. Bhattacharjee, learned Addl. Senior Government Advocate, Assam for the opposite parties/respondents.

By filing this application, the applicants have sought for modification of the order dated 11.04.2025, passed by this Court in WP(C) No.1494/2025.

This Court, by the order dated 11.04.2025, having considered the submissions of learned counsel for the parties, directed that the respondent authorities may allow the petitioners to participate in the selection process, pursuant to the advertisement dated 26.12.2024, if the selection process has not already over by then, for the post of Anganwadi Worker against the No.50 Barkhetri-Barni-2 Anganwadi Center, under the Paschim Nalbari ICDS Project.

It is the contention of the learned counsel for the applicants that despite several approaches, the applicants have not been allowed to participate in the interview, which was scheduled on 27.06.2025.

On the other hand, Ms. M. Bhattacharjee, learned Addl. Senior Government Advocate, Assam submits that there is nothing on record to show that the applicants have approached the authorities to allow them, after the order dated 11.04.2025, passed by this Court.

Issue notice returnable in four (4) weeks.

Since, Ms. M. Bhattacharjee, learned Addl. Senior Government Advocate, Assam enters appearance and accepts notice on behalf of all the respondents, no formal notice needs to be served. However, requisite extra copies be furnished to the learned State Counsel.

Having considered that this Court on 11.04.2025 has directed the respondent authorities to allow the petitioners to participate in the interview, pursuant to the advertisement dated 26.12.2024, for the No.50 Barkhetri-Barni2 Anganwadi Center, under the Paschim Nalbari ICDS Project, if the selection process has not already been completed and considering that the interview has been conducted on 27.06.2025, till the returnable date, no result shall be declared, in pursuant to the interview dated 27.06.2025, in respect of No.50 Barkhetri-Barni-2 Anganwadi Center, under the Paschim Nalbari ICDS Project.

List the matter after four (4) weeks.
