GUWAHATI, India, Nov. 6 -- Gauhati High Court issued the following order on Oct. 7:

1. Heard Mr. A. K. Ahmed, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor.

2. This petition under Section 482 BNSS is filed by the petitioner, namely, Mehebur Islam @ Mehebub Islam, apprehending arrest in connection with Goroimari P.S. Case No. 75/2025 registered u/s 137 /296 /351(2) /62 of BNS, 2023.

3. The case arose out of an ejahar dated 15.08.2025 lodged by the father of the alleged victim girl. The gist of allegation is that on the date of the incident the accused petitioner tried to take away the informant's daughter from a girl's hostel but due to the intervention of the hostel authorities and other students, she could not be done so.

4. The learned counsel for the petitioner has submitted that except Section 62 of the BNSS, other offences are bailable in nature. While confirming the same learned Additional Public Prosecutor Mr. K. Baishya submits that Section 62 BNSS [corresponding to Section 511 of IPC earlier] is with regard to the other provisions and therefore, if the same is also bailable, then the instant petition would not be maintainable.

6. However, I am of the view that at this stage, the accused petitioner should be given an opportunity to get his statement recorded before the police.

7. Accordingly, the petitioner named above, in the event of his arrest in connection with this case, he shall be released on interim pre-arrest bail, in connection with the above noted case, on furnishing bail bond of Rs. 20,000/- with one surety of like amount to the satisfaction of the arresting authority, subject, of course, to the following conditions:

(a) shall co-operate with the investigation and make himself available for examination;

(b) he should not intimate or harass the alleged victim girl or her family members.

Violation of any of the bail conditions shall entails cancellation of interim bail.
