GUWAHATI, India, June 23 -- Gauhati High Court issued the following order on May 23:
1. Heard Mr. A. W. Aman, learned counsel for the petitioner and Mr. K. K. Das, learned Additional Public Prosecutor, Assam for the State.
2. Apprehending his arrest, the petitioner, namely, Md. Joynal Ali @ Joynal Abedin, resident of Village-No.3 Dawaguri, Police Station-Gossaigaon, District - Kokrajhar has filed this application on 13.05.2025 under Section 482 BNSS, seeking pre-arrest bail in Gossaigaon P.S. Case No. 45/2025 corresponding to G.R. No. 50/2025 registered under Sections 325/3(5) of BNS, read with Section 13(1) of the Assam Cattle Preservation Act, 2021.

As per the FIR dated 30.03.2025, lodged before the Officer-in-Charge of Gossaigaon Police Station, the case is that on 30.05.2025 in the morning around 08:00 AM reliable source information was received by the complainant that the accused persons of the case, namely, Md. Kalam, son of Joynal Abedin and Md. Joynal Ali, son of Kudrat Ali and others of Village No.3 Dawaguri, P.S-Gossaigaon, District-Kokrajhar had illegally slaughtered cattle at Village No.3 Dawaguri near L. P. School, Dawaguri in a bamboo garden and have been selling the same. On receipt of the information police personnel from Gossaigaon Police Station proceeded to the place of occurrence and seeing police, the accused persons fled away from the scene. Police accordingly seized 120 kgs suspected beef meat, weighing balance and a mobile phone. The said FIR was accordingly registered as Gossaigaon P.S. Case No. 45/2025 corresponding to G.R. No. 50/2025 under Sections 325/3(5) of BNS, read with Section 13(1) of the Assam Cattle Preservation Act, 2021.
4. Perused the case diary placed before the Court today by Mr. K. K. Das, learned Additional Public Prosecutor, Assam.
5. From the case diary it is seen that police is yet to receive the FSL report with regard to the seized meat.
6. Case diary placed before the Court consist sufficient materials against the petitioner with regard to his involvement in the alleged crime.
7. It is also seen that the in the statements of the independent witnesses so far recorded by the concerned Investigating Officer of the case as well as the arrested accused persons of the case have implicated the petitioner, Md. Joynal Ali @ Joynal Abedin.
8. Finding sufficient incriminating materials in the case diary against the petitioner with regard to his involvement in the alleged crime, this Court is of the view that it is not a fit case to grant pre-arrest bail to the petitioner, Md. Joynal Ali @ Joynal Abedin in said Gossaigaon P.S. Case No. 45/2025 corresponding to G.R. No. 50/2025.
9. Accordingly, this pre-arrest bail application of the petitioner, Md. Joynal Ali @ Joynal Abedin in said Gossaigaon P.S. Case No. 45/2025 corresponding to G.R. No. 50/2025 stands rejected.
