GUWAHATI, India, July 2 -- Gauhati High Court issued the following order on June 2:
1. Heard Mr. S Dutta, learned senior counsel for the petitioner assisted by Ms. P Bhagat, learned counsel.
2. The grievance of the petitioner is that the petitioner LLP, an MSME, sought for restructuring of their loan accounts maintained with the respondent Bank. However, the respondent Bank has refused to entertain such application and insisting on concurrence of all the partners, whereas it is the case of the LLP that two of the partners are missing and therefore, fulfillment of such condition imposed by the Bank is impossible.
3. Issue notice, returnable by four weeks.
4. Mr. M Sharma, learned counsel accepts notice on behalf of the respondent No.1.
5. Steps upon the respondent No.2 to be taken by way of Registered Post with A.D as well as through usual process within five days.
6. As the respondent No.1 is duly represented, no formal notice is required to be issued, however, extra copies of the writ petition be served upon the learned counsel for the respondent No.1 within five days.
