GUWAHATI, India, May 11 -- Gauhati High Court issued the following order on April 11:
Heard Ms. S G Baruah, learned counsel for the applicant as well as Ms. S. H. Bora, learned Additional Public Prosecutor, Assam.
Also heard Mr. Surajit Das, learned Amicus Curiae appearing for the respondent no. 2.
The petitioner was convicted in Special (POCSO) Case No. 22/2022 by the learned Special Judge, Udalguri.
The connected appeal is still pending.
Ms. Baruah has submitted that on 18.04.2025, the sister of the petitioner is getting married and, therefore, on that ground, he may be allowed to go on bail for a limited period of time for attending the marriage ceremony of his sister.
Considering entire aspect of the matter, prayer of the petitioner is allowed. The petitioner is allowed to attend the marriage ceremony of his sister which is scheduled to be held on 18.04.2025.
Therefore, it is hereby directed that the petitioner, Kaushik Baro @ Kaushik Boro, who has been convicted by the learned Special Judge, Udalguri in Special (POCSO) Case No. 22/2022 shall be released on bail only on 16.04.2025 by executing a bond of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Special Judge, Udalguri or the Judicial Officer, whoever will be the in charge of the Court of the Special Judge, Udalguri on that day.
The petitioner is allowed to remain on bail on 16.04.2025. 17.04.2025, 18.04.2025 and 19.04.2025.
It is further directed that on 20.04.2025 the petitioner shall surrender before the authority concerned.
The petitioner is directed not to contact or meet/visit the informant and the victim girl. With the above, the present interlocutory application is disposed of.
