GUWAHATI, India, Nov. 5 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard Ms. G. Borah, learned counsel for the petitioner. Also heard Mr. B. Sharma, learned Addl. P.P., Assam for the State respondent as well as Mr. Kamaleswar Singh, learned counsel for the informant.
2. Ms. Borah, the learned counsel for the petitioner contends that the present petitioner is not named in the FIR and that in an another case arising out of the same alleged activities, he was granted anticipatory bail by this Court in AB/2413/2024 on 08.10.2024. It is contended that the procedural requirements under Section 35(3) BNSS have been violated, thereby causing infirmity in the arrest of the petitioner the learned Addl. PP submits that the alleged offences are of a serious nature and the Case Diary is essential but the same has not yet been received.
3. On the other hand, Mr. Singha, the learned counsel for one of the victim strongly opposes the grant of bail.
4. Issue fresh requisition for the Case Diary.
5. The learned prosecution shall also apprise the Court on subsequent dates regarding the procedural compliance. 6. List on 13.10.2025 for producing the Case Diary.
