GUWAHATI, India, July 1 -- Gauhati High Court issued the following order on June 2:

1. Heard Mr. D. K. Agarwala, learned counsel for the petitioner. Also heard Mr. M. R. Adhikari, learned CGC appearing for the respondent No.1 and Mr. P. Sarmah, learned Additional Senior Govt. Advocate appearing for the respondent No.2.

2. The learned counsel for the petitioner has submitted that an Emergency Certificate has been issued by the Nigeria High Commission, New Delhi on 22.05.2025 in the name of the petitioner, namely, Kamardeen Oaladeji Oladimeji. It is submitted that the physical copy was received on 28.05.2025. However, he is instructed that the petitioner would have to personally make an application for an exit permit through the concerned FRRO, which can only be applied online by the petitioner.

3. As the petitioner is currently lodged in the Transit Camp, Matia, Goalpara, we have requested Mr. J. Payeng, learned Standing Counsel for the FT matters to transmit a downloaded copy of this order to the Superintendent, Transit Camp, Matia, Goalpara as well as to the concerned officials of the authorities of the Home & Political (B) Department so as to provide facilities to the petitioner for making an application for issuance of a exit permit through the online mode before the FRRO, Kolkata.

4. We take note of the submissions made by the learned counsel for the petitioner that the Emergency Certificate issued on 22.05.2025 would be valid only for a month and therefore, there is every likelihood that the same would expire on 21.06.2025.

5. By an order dated 16.05.2025, the Court has already impleaded the Ministry of External Affairs New Delhi as respondent No.3. Necessary correction of the cause-title has also been made by the Registry.

6. We have noted the various communications made by Mr. M. R. Adhikari, learned CGC to the concerned authorities including FRRO, Kolkata as well as to the Ministry of External Affairs. We put on record our appreciation for the effort taken by the learned CGC in the matter.

7. Accordingly, let a copy of this order be also transmitted by him to the respondent Nos. 1 and 3 so as to enable them to communicate with the Foreigners Regional Registration Office, Kolkata so as to facilitate issuance of the "exit permit" of the petitioner, namely, Kamardeen Oaladeji Oladimeji.

8. On the next date of listing, the learned Standing Counsel for the FT matters is asked to provide information as to whether appropriate facilities have been made available to the petitioner for making an online application before the FRRO, Kolkata for issuance of "exit permit".

9. List on 04.06.2025.
