GAUHATI HIGH COURT ISSUES ORDER ON KABI SARMA V/S SAMIN BARMAN AND ANR

GUWAHATI, India, Nov. 2 -- Gauhati High Court issued the following order on Oct. 8:

1. Heard Mr. N.N.B Choudhury, learned counsel assisted by Mr. P.K. Basu, learned counsel for the applicant/petitioner.

2. This is an interlocutory application filed under Order-XLI Rule 5, read with Section 151 of the CPC, 1908, whereby the applicant/petitioner is seeking stay of the impugned order dated 20.09.2025, passed by the learned Civil Judge (Senior Division), Baksa at Mushalpur in Title Execution No.01/2025.

3. Issue notice upon the two respondents.

4. Steps may be taken expeditiously.

5. Till the next date of listing, further proceedings of Title Execution No.01/2025 shall remain stayed.

6. Needless to say that the respondents upon their appearance shall be at liberty to seek vacation/alteration or modification of the aforesaid interim order.

7. List on 13.11.2025.
