GUWAHATI, India, Nov. 5 -- Gauhati High Court issued the following order on Oct. 8:
1. Heard Mr. B. Chowdhury, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor for the State.
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, 1. Hanif Ali, has prayed for grant of bail in connection with Tezpur P.S Case No. 559/2025 corresponding to G.R No. 1251/2025 registered under Sections 21(b)/29 of NDPS Act.
3. The gist of allegations is about seizure of intermediate quantity of suspected heroin from the accused person, who is stated to have been arrested on 11.08.2025 and has completed 58 days in pre-trial detention. The applicable statutory period is 60 days.
4. It is submitted by the learned Additional Public Prosecutor for the State that case diary has not yet been received. Today, this Court is a vacation bench and by the time, the Court reopens on a regular basis on 13.10.2025 - the said statutory period would already be over.
5. In a given facts and circumstances, the accused petitioner is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of the like amount subject to the satisfaction of the concerned learned court with following conditions:
(i) That the accused petitioner shall cooperate with the remaining investigation;
(ii) That the accused petitioner shall not indulge in any activity involving the consumption or peddling narcotic drugs;
(iii) That the accused petitioner shall not hamper or tamper with evidence. 6. Violation of bail conditions might entail cancellation of the bail.
7. With the above observations, this bail petition stands allowed and stands disposed of.
