GUWAHATI, India, May 11 -- Gauhati High Court issued the following order on April 11:
Case taken up before the Lawazima Court.
Learned counsel Ms. B. Sarma appears on behalf of the appellant. Heard. Perused the records.
Perusal of the office note dated 11.04.2025 reveals that notice was issued to the respondent No. 2 through the office of the learned Public Prosecutor, Assam on 17.03.2025.
Now, in regard to the aforesaid notice issued to the respondent No. 2, it appears that the service report has been received from the office of the learned C.J.M, Jorhat, wherein, it has been stated that the respondent No. 2 was absent at the time when process server reached his address and in his absence, his mother, namely, "Smti Nijora Gogoi" received the notice. The service report further stated that the recipient (i.e, mother of the respondent No. 2) has acknowledged the receipt of the notice by putting her signature on the return copy of the notice,
Further, it has been observed from the online Case Information System that the respondent No. 2 has engaged learned counsel Ms. L. Devi as a legal aid counsel for representing him in the instant appeal.
In view of the observations made above, it may be said that service in respect of the respondent No. 2 has been completed.
Accordingly, the matter may be placed before the Hon'ble Court.
