GUWAHATI, India, June 3 -- Gauhati High Court issued the following order on May 3:
Heard Mr. Agarwala, learned counsel for the applicant. Also heard Ms. P. Borthakur, learned counsel appearing on behalf of the respondent no.2.
This is an application filed under Section 5 of the Limitation Act, 1963 for condonation of delay of 56 days in preferring the connected appeal.
The ground for delay in preferring the connected appeal has been explained in paragraph 3, 4 & 5 of the delay condonation petition.
Upon perusal of the averment made in the above paragraph, this Court is of the view that, the applicant was prevented by a sufficient cause in not preferring the connected appeal within time.
Moreover, Ms. P. Borthakur, learned counsel appearing on behalf of the respondent no.2 has no objection in condoning the delay.
In view of the above, the delay of 56 days in preferring the connected appeal is hereby condoned.
The Registry shall register the connected appeal and list it for admission by showing the name of Ms. P. Borthakur, as the learned counsel for the respondent no.2.
