GUWAHATI, India, April 3 -- Gauhati High Court issued the following order on March 2:
1. Heard Mr M U Mondal, learned counsel appearing for the petitioner. Also heard Mr B Sharma, learned Additional Public Prosecutor for the State of Assam.
2. The learned counsel for the petitioner has placed before this Court the order dated 05.02.2026, passed by the learned Trial Court granting bail to three of the named accused in the FIR, which is also an issue in this anticipatory bail application.
3. The learned Additional Public Prosecutor has submitted that the Case Diary is yet to be received and the service report on the respondent No. 2 is also awaited.
4. Steps were taken on 19.02.2026.
5. On the next date fixed, the learned Additional Public Prosecutor shall have definite instructions whether the respondent No. 2 has been served and further will also have the updated Case Diary for production before this Court.
6. This Court has noticed that the learned Trial Court has granted bail to the accused who were taken into custody, since the statements of the alleged victims did not implicate the accused therein and it also took into consideration that no TIP was done to identify the accused persons by the victims. The length of judicial custody had also been taken into consideration.
7. List this matter again on the 6 th of March, 2026.
