Heard Mr. S.C. Biswas learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application filed under Section 482 of the BNSS, 2023, whereby the petitioner, namely, Aarian Kashyap Kakati is seeking Anticipatory Bail apprehending arrest in connection with an FIR, which is registered at Dispur Police Station Case No. 132/2026 registered under Sections 103(1)/238/61(2)/3(5) of BNS, 2023.
3. The Case Diary as called for has been received along with the FSL Report and as per the FSL Report the FST Report, the petitioner died on account of venticular fibrilation following ingestion of ethyl alcohol.
6. There are no materials in the case diary to establish that it was the petitioner who was responsible for the deceased having ingested alcohol. Accordingly, the custodial interrogation of the petitioner may not be necessary. Accordingly, the prayer for pre-arrest bail is allowed.
7. The order of interim pre-arrest bail dated 26.02.2026 is hereby made absolute.
8. Send back the case diary.
9. This anticipatory bail petition stands disposed of.
