GUWAHATI, India, June 4 -- Gauhati High Court issued the following order on May 5:
Heard Mr. N. Gogoi, the learned counsel for the petitioner. Also heard Mr. M. P. Goswami, the learned Additional Public Prosecutor for the State respondent.
The learned counsel for the petitioner has submitted that this anticipatory bail application has been filed by the petitioner as he is apprehending his arrest in connection with a Complaint Case No. 136/2024 under Sections 34/120(B)/448/379/384/307/506 of the Indian Penal Code.
It appears that there is nothing on record from which it can be found out as to under what provisions the Trial Court cognizance of the offences against the present petitioner.
It also appears that one of the co-accused has already been granted bail in this case by the Trial Court itself and, therefore, a doubt appears as to whether the cognizance offence under Section 307 of the Indian Penal Code was taken by the Trial Court or not.
On this, the learned counsel for the petitioner sought for some time to submit the relevant documents in this regard.
The prayer is allowed.
Let this case be listed again on 14.05.2025.
