GUWAHATI, India, July 29 -- Gauhati High Court issued the following order on June 30:

1. Heard learned Senior Counsel Mr. M.K. Choudhury for the writ petitioner Khadeza Khatun, who is aggrieved by the order of transfer and posting at Nalbari vide order dated 25.06.2025, marked as Annexure-6 of the petition.

2. It is submitted that on the same date, an order was passed transferring and promoting the petitioner as Matron at Guwahati. Thereafter, on the same date, vide Annexure-5, the order No. NS/EMP/25/pt-III/2000/278, was cancelled and the petitioner's place of posting was changed from Guwahati to Nalbari. It is submitted that if this order, transferring the petitioner to Nalbari is not stayed, the petitioner will be highly prejudiced as the petitioner is suffering from arthritis and the petitioner is the senior most Assistant Matron of the institution.

3. Heard Mr. A. Chaliha, learned Standing Counsel for the Health Department, who has raised serious objection stating that the private respondent No. 5 Suwala Deka's promotion was considered, considering her age and seniority. It is also submitted by the learned Standing Counsel that it is not only the petitioner whose transferred has been changed vide the impugned order of transfer, but the postings of other employees of the Health Department were also changed.

4. Learned Standing Counsel for the Health Department has submitted for time to produce records relating to cause of transfer and whether the transfer was affected on public interest.

5. Records may be produced.

6. List this matter on 18.07.2025.

7. Petitioner to take steps to issue notice to the private respondent No. 5, Suwala Deka, returnable on 18.07.2025.

8. Till then, a status quo in respect to the petitioner Khadeja Khatun and respondent No. 5 Suwala Deka vide the Order No. NS/EMP/25-pt-111/2000/278 dated 25.06.2025 to be maintained as of today and till the next date (18.07.2025).

9. List accordingly.
