GUWAHATI, India, Nov. 30 -- Gauhati High Court issued the following order on Oct. 29:

1. Heard Mr. H.R.A. Choudhury, learned Senior Counsel for the petitioners. Also heard Ms. S. Bora, learned Addl. Public Prosecutor.

2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying for pre-arrest bail to the accused/applicant, namely, 1. Abdul Kalam and 2. Siraj Uddin in connection with RK Nagar P.S. Case No 68/2025 registered under Sections 189(2)/ 127(2)/ 296/ 118(2)/ 109/ 352/ 351(3)/ 351(4) of BNS,2023.

3. The allegation as depicted in the FIR is that the informant of the instant case one Sadique Ali lodged an FIR on 22.09.2025, before the Officer In-charge, Ramkrishnanagar police station alleging inter alia that on 21/09/2025 at Dolugang area, a bichar was held against his son Ruful Amin as he abused an Islamic scholar namely Sarimul Haque with filthy language through his mobile phone. He also stated that his son apologized at the end of bichar. However, the accused persons got incited and asked his brother Samsul Haque to shave his son's head and was also garlanded with shoes. It was further alleged that the accused persons threatened and attacked him and his son with dao. On receipt of the FIR, the O/C Ramkrishnanagar P.S. registered the instant case under the aforesaid sections of law and police started the investigation.

4. Call for the CD alongwith medical report.

5. Having regard to the nature of allegations, it is provided that in the event of this arrest in connection with the aforesaid case, the petitioners shall be released on interim pre-arrest bail of Rs. 20,000/- with one surety each of like amount to the satisfaction of the arresting authority of the said case subject to the following conditions:

1) The accused petitioners shall appear the I.O. as and when required.

2) The accused petitioners shall co-operate with the investigation.

3) The accused petitioners will not induce or threaten anybody who is acquainted with the facts of the present case.

6. List the matter again on 18.11.2025.
