AMARAVATI, India, March 1 -- Andhra Pradesh High Court issued the following order on Jan. 29:
Petition under Order XLI Rule 5 R/w Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to stay the operation of the judgment and decree the Judgment and Decree dated 07-08-2025 passed in O.S.No.443 of 2012, by the learned XIII Additional District Judge disposal of AS 19 of 2026, on the file of the High Court.
The petition, coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri.CHINTHA UMR Advocate for the Petitioners, Sri.SATYANARAYANA DHARA Advocate for the Respondents and the Court made the following.
ORDER:
This appeal has been filed by the 2 respondent's suit nd defendant. The plaintiff/1 was decreed vide Judgment and decree dated 07.08.2025 in the following terms:-
"i) that the suit be and the same is hereby decreed with costs,
ii) that the plaintiff is directed to pay balance consideration of Rs.20,39,000/- and also interest @ 12% on the balance consideration from 13.08.2012 till the date of execution.
iii) that the defendants are directed to execute a regular sale deed in favour of plaintiff within three months,
iv) that if the defendants failed to execute a registered sale deed in favor of the plaintiff within the stipulated period, the plaintiff is at liberty to proceed against the defendants to obtain a regular sale deed, in due process of law and
V) that the defendants do pay to the plaintiff a sum of Rs.1,89,518/- towards costs of the suit and do bear their own institutional suit costs of Rs.Nil. (No bill of cost Is filed by defendants)".
2. In the first call, there was no representation for the appellant, the matter was passed over.
3. In the revised call also, there is no representation for the appellant.
4. List In due course.
5. Merely, on the ground of the pendency of this appeal, the execution proceedings if any pending shall not be adjourned.
