AMARAVATI, India, May 24 -- Andhra Pradesh High Court issued the following order on April 23:
1. This Court has disposed of the Writ Petition directing the 4th respondent to follow due process of law before initiating any action against the subject property of the Writ Petition No.16970 of 2024. The contempt case is filed stating that the respondents are intending to construct water tank on the petitioner's land and destroying the petitioner's house constructed with iron sheets, demonstrates a blatant disregard of the authority against the orders passed by this Court. Hence, the respondents are liable for punishment under the provisions of Contempt of Courts Act, 1971.
2. The 1st respondent filed counter. It is stated in the paragraph No.5 that after receiving the orders from this Court, the 1st respondent has not taken any further steps against the subject property and conducted general body meeting on 03.09.2025 and passed a resolution No.60 on the same day to propose an alternative site i.e., R.S.No.98/2 (L.P.No.42/1994, VGTM UDA) which is also a common site of the gram panchayat to construct the water tank. There is no willful negligence in compliance of this Court order. There is no interference by the 1st respondent in the subject property in Sy.No.96/2B.
3. The learned counsel for the petitioner also stated that subsequent to the filing of the Contempt Case, there is no interference by the respondents.
4. Recording the said submission, the present Contempt Case is closed.
There shall be no order as to costs. Consequently, Miscellaneous Petitions, pending in the contempt case shall stand closed.
