AMARAVATI, India, March 18 -- Andhra Pradesh High Court issued the following order on March 12:
1. The above contempt case was filed complaining violation of the order dated 05.12.2024 in W.P.No.24797 of 2023.
2. Petitioner filed the aforementioned writ petition to declare the action of respondents in not releasing the pensionary benefits of the petitioner, as illegal and arbitrary.
3. The writ petition was disposed of and the operative portion of the order reads thus:
"11. Thus, the Charge Memos vide G.O.Rt.No.252, Animal Husbandry, Dairy & Fisheries (DY & VIG) Department dated 30.08.2023 (Ex.P1) in W.P.No.31273 of 2023 and G.O.Ms.no.46, dated 04.12.2023b (Ex.P1) in W.P.No.33402 of 2023 issued against the petitioner are hereby quashed. As the charge memos against the petitioner were quashed, withholding of retirement benefits does not arise. Hence, the 1st respondent shall release the retirement benefits to the petitioner within six (06) weeks, as per the rules."
4. The contempt case was filed on 18.02.2025. Pending the contempt case, the respondents paid the retirement benefits to the petitioner.
5. Sri V.V.N.Narayana Rao, learned counsel for the petitioner would submit that since the respondent paid the gratuity amount belatedly, the petitioner is entitled for interest as per the Act.
6. Since the amount was released and paid to the petitioner, this Court is not going into the aspect of interest and this Court is of the considered opinion the respondent complied with the order in the writ petition.
7. Accordingly, the Contempt Case is Closed. No costs. This order will not preclude the petitioner from claiming statutory benefits, if any, as per law.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
