AMARAVATI, India, May 6 -- Andhra Pradesh High Court issued the following order on April 2:
1. Heard Sri C. Upendra, learned Counsel appearing on behalf of Sri T.V. Sri Devi, learned Counsel for the Contempt Petitioners, Sri B. Ramesh, learned Counsel appearing on behalf of Smt. Sushma Yaganti, learned Counsel for the Respondent Nos.1 & 2 and Sri G.R. Sudhakar, learned Counsel for the Respondent Nos.3 to 6.
2. The present Contempt Case is filed by the Respondents in W.P.No.27647 of 2024 complaining of violation of the Interim Order of this Court dated 27.11.2024. The relevant portion of the Order of this Court in Para No.3 would indicate that this Court ordered for restoration of status-quo ante and ensure proper access to the residents by filling-up the trench with soil.
3. In the penultimate paragraph of the Report of the Tahsildar dated 17.12.2024, it is stated that the present Writ Petitioners are trying to fill with metal and cement. It is the submission of the learned Counsel for the Petitioners who are the Respondents in the Writ Petition that the Writ Petitioners/Contemnors herein had laid a pakka road with metal and cement. Neither the Photographs produced by the Writ Petitioners nor the Photographs produced by the Respondents, which this Court has perused would indicate that the road has been laid with metal and cement. The Photographs nodoubt indicate that along with soil, metal was also used. Para No.3 of the Order indicates that this Court had directed to lay a road which shall ensure proper access to the residents without any hindrance. In any case, the Photographs themselves would falsify the fact that the Writ Petitioners have laid a pakka cement road. The Photographs themselves clearly indicate that it is a mud road which has been laid by covering it with layer of metal. This act on the part of the Writ Petitioners, per se does not constitute contempt. Therefore, this Contempt Case is devoid of any merit. Accordingly, the Contempt Case is dismissed. No Order as to Costs.
4. Interlocutory Applications, if any, stand closed in terms of this order.
