AMARAVATI, India, Feb. 25 -- Andhra Pradesh High Court issued the following order on Jan. 23:

1. This Court, vide order dated 28.01.2025 in W.P.No.2164 of 2025, directed the respondents to take immediate steps to prevent letting out of water from the water tank i.e., Ramannapantacheruvu, Navabpeta Village.

2. Learned counsel for the petitioner appeared through online and submitted that despite the directions issued by this Court to the respondents not to let out water, the respondents have not taken any steps to stop the leakage from Ramannapantacheruvu. It is further submitted that several writ petitions have been filed by the farmers, including W.P.No.14624 of 2024, in which similar directions were issued by this Court, and pursuant to such directions, the respondents had taken steps to prevent letting out of water from Ramannapantacheruvu.

3. Learned counsel for respondent Nos.3 to 6 have filed counter-affidavit and stated that due to shortage of staff, it was difficult to monitor the tank. The Assistant Executive Engineer, Irrigation, was requested to appoint a luskar to oversee the tank and regulate release water into Ramannapantacheruvu from the NSP Canal. It is further stated that due to seriousness of the Court case, after inspecting the tank, a complaint was lodged before the SHO, Penuganchiprolu, on 28.01.2025, seeking immediate action against the persons responsible for the breach. Therefore, there is no such intention to defy the orders of this Court and prayed to purge from the contempt case.

4. Therefore, the Contempt Case is closed. However, as there is presently no leakage, as submitted by the learned counsel for the petitioner, the respondents are directed to ensure that no water is let out from the said Ramannapantacheruvu. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, pending in the contempt case shall stand closed.
