AMARAVATI, India, June 17 -- Andhra Pradesh High Court issued the following order on May 14:

1. The Writ Petition has been filed for the following relief:

"...pleased to order, writ or direction more particularly in the nature of Writ of Mandamus Under Article 226 of the Constitution of India questioning the action of the respondents in seeking dispossession of the petitioner from his property in an extent of Ac.0.60 cents, Ac. 1.20 cents, Ac. 1.80 cents, Ac.0.50 cents in Sy.No.122, Ac.0.45 cents in Sy.No.49-3, Ac.0.90 cents, Ac.0.60 cents in Sy.No.50-3, Ac.0.80 cents, Ac.0.80 cents, Ac.1.56 cents in Sy.No.51-1 situated at Kodigenahalli Village Polam, Parigi Mandal, Sri Sathya Sai District Erstwhile Anantapur District without following any procedure under law and without issuing any notice or any proceedings as illegal, arbitrary and against to principles of natural justice and against to principles of natural justice and violative of Article 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to dispossess the petitioner from the above said property without following due process of law ..."

2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader for Revenue Department.

3. Mr. P. Narahari Babu, learned counsel for the Petitioner, submits that without following due process of law, Respondent Nos.3 and 4 have been attempting to dispossess the Petitioner from the schedule property.

4. Sri B. Venkata Satyanarayana, learned Assistant Government Pleader for Revenue, on written instructions, submits that O.S.No.14 of 2023 is pending on the file of the learned Senior Civil Judge, Hindupur, between the Petitioner and some third parties. The Petitioner has not impleaded those third parties as Respondents in the present Writ Petition. It is not in dispute that a status quo order has been passed in I.A.No.170 of 2023 in O.S.No.14 of 2023 by the competent Civil Court.

Having regard to the facts and circumstances of the case, and upon recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Nos.3 and 4 not to dispossess the Petitioner from the schedule property without following due process of law.

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
