AMARAVATI, India, March 24 -- Andhra Pradesh High Court issued the following order on Feb. 20:
1. The above contempt case was filed complaining of the violation of the order dated 04.11.2024, passed in W.P.No.24852 of 2024.
2. Heard learned counsel appearing on both sides.
3. The petitioner filed the aforementioned writ petition to declare the action of the respondents in not concluding the seven disciplinary proceedings pending against the petitioner, as illegal and arbitrary.
4. The writ petition was disposed of on 04.11.2024. In para No.5 of the order, this Court observed as follows: "Learned Assistant Government Pleader for Services on instructions would submit that the respondents will complete inquiry in terms of G.O.Ms.No.679 General Administration (Services-C) Department, dated 01.11.2008 and G.O.Ms.No.91 General Administration (Ser-C) Department, dated 12.09.2022."
In para No.8 of the order dated 04.11.2024, this Court observed as follows:
"Given the facts and circumstances of the cases, the writ petition is disposed of, at the admission stage with the consent of both learned counsel directing the respondents to conclude the inquiry within three months from the date of receipt of the copy of the order. It is needless to say that the petitioner shall cooperate with the inquiry. Delay, if any, on the part of the petitioner, the respondents can seek an extension of time. If the inquiry is not concluded within three months after receipt of the order copy, the inquiry proceedings in respect of charge memos shall stand quashed without reference to any further orders. No order as to costs."
5. The above contempt case was filed on 19.03.2025, and thereafter, the matter was adjourned at the request of learned counsel appearing for respondents. Since this Court opined that the respondents have violated the order dated 04.11.2024, passed in W.P.No.24852 of 2024, deliberately and intentionally, the contempt case was admitted on 05.02.2026 by framing charges.
6. Today, Sri M.M. Nayak, learned 1st respondent/contemnor, appeared before this Court.
7. Sri Ramalingeswara Rao Kocharla Kota, learned counsel appearing for respondents, submitted a Memo No.3073051/TW.Ser./A2/2026, dated 25.02.2026. In para No.6 of the memo, it was noted as follows:
"6. After careful examination of the entire matter in detail and in compliance with the orders dated 04.11.2024 of the Hon'ble High Court of Andhra Pradesh in W.P. No. 24852 of 2024, the Govt., hereby drops further action in the disciplinary proceedings pending against Sri G.S.V.V.S.S.V. Prasad, Superintending Engineer (I/c), TW, Visakhapatnam and ENC (FAC), Tribal Welfare, as mentioned above, subject to the outcome of Writ Appeal No.195 of 2026 filed by the Government before the Hon'ble High Court."
