AMARAVATI, India, Feb. 9 -- Andhra Pradesh High Court issued the following order on Jan. 8:
1. Heard Sri Nikhil Kashyap, learned counsel representing Sri D.V.Sasidhar, learned counsel for the petitioner.
2. The above contempt case was filed complaining about the violation of the interim order dated 03.12.2024 in W.P.No.28201 of 2024.
3. The petitioner filed the aforementioned writ petition impugning the proceedings vide Rc.No.A3/ENDW-NABCOGEN/58/2024 dated 14.11.2024 issued by the 5 th respondent. The said proceedings were suspended by an interim order dated 03.12.2024 and the writ petition is still pending consideration.
4. Sri Nikhil Kashyap, learned counsel representing Sri D.V.Sasidhar, learned counsel for the petitioner, would submit that in pursuance of the interim order, the petitioner was taken back into service and was paid salary till February, 2025. Thereafter, the salary was not paid to the petitioner.
5. Thus, as seen from the material available on record and the submissions made by the learned counsel for the petitioner, the respondents have complied with the interim order dated 03.12.2024 in W.P.No.28201 of 2024. If the respondent authority fails to pay or release the salary to the petitioner, since the writ petition is pending, the petitioner, according to this court, ought to have filed an interlocutory application in the writ petition seeking appropriate relief.
6. This Court is of the considered opinion that the interim order dated 03.12.2024 in W.P.No.28201 of 2024 has not been violated.
7. Accordingly, the contempt case is dismissed. However, this order will not preclude the petitioner from filing an appropriate application seeking appropriate relief in the pending writ petition. No costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
