AMARAVATI, India, June 1 -- Andhra Pradesh High Court issued the following order on April 30:

1. The above contempt case was filed complaining of violation of the order dated 11.03.2024 in W.P.No.34956 of 2014.

2. The petitioner filed the aforementioned writ petition to declare the action of respondent No.3 in not initiating any action vis-a-vis the construction of a Temple and community hall in the residential area, by respondent No.6 in the writ petition (hereinafter referred to as 'respondent No.6'), as illegal and arbitrary.

3. The said writ petition was disposed of on 11.03.2024, and the operative portion of the order reads as follows:

"Thus, as seen from the averments in the counter affidavit, the respondent No.3 set the law into motion by issuing provisional notice and confirmation order. Therefore, in the facts and circumstances of the case, the writ petition is disposed of directing the Commissioner of respondent No.3 to take necessary steps in accordance with law, pursuant to the provisional notice and confirmation order. Petitioner as well as respondent No.6, shall be provided an opportunity of hearing, if necessary, before initiating any further action in accordance with law. No costs."

4. In the affidavit filed in support of the contempt case, it was pleaded that the respondents failed to comply with the order.

In the counter affidavit filed on behalf of the respondent, it was contended, inter alia, that in pursuance of the order in the writ petition, an endorsement vide R.O.C.No.496/2020/G1 dated 18.11.2024 was issued directing respondent No.6 to appear before the Municipal Commissioner, Rayadurg Municipality, on 28.11.2024 along with registered documents etc. A copy of the said endorsement was also communicated to the petitioner. Respondent No.6 submitted an explanation; however, failed to produce a registered document. Later, he submitted a registered document No.860 of 1999 dated 27.07.1999. As the subject site is a private site, a fresh provisional order, dated 17.01.2025 was issued, and thereafter, a confirmation order dated 28.01.2025 was issued to the present President, Rajaka Sangham, in excise of powers under Section 340(1) of the Andhra Pradesh Municipalities Act 1965 (for short 'the Act'), charge sheet was filed against respondent No.6 in the writ petition, on the file of learned Junior Civil Judge, Rayadurg vide C.C.No.493 of 2025. The Court imposed a penalty, and respondent No.6 paid the penalty.

6. Thus, as seen from the averments in the counter affidavit, the respondent authorities followed the procedure under the Act.

7. Since the respondent/contemnor acted upon the order and proceeded further pursuant to the order dated 11.03.2024, this court does not find any violation.

8. Hence, this contempt case is dismissed. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
