AMARAVATI, India, Feb. 9 -- Andhra Pradesh High Court issued the following order on Jan. 8:

1. The contempt case is filed alleging violation of the interim orders dated 17.9.2020 passed in Writ Petition No.16639 of 2020 , wherein after perusing the material on record, this Court granted an interim direction to the respondents not to interfere with the peaceful possession and enjoyment of the land of an extent of Ac.1.00 cents in Sy.No.1240-10 situated at Jangam Raju Palle Village.

The learned counsel for the petitioner, inter alia sumbits that despite the said interim order, the respondent No.2 herein issued a notice dated 29.9.2021 on instructions of the respondent No.1 herein and pursuant to the said notice, attempts were made to dispossess the petitioner from the subject land and under those circumstances, the present Contempt Case is filed.

3. Mr.P.Subash, learned counsel representing the respondent No.2 made submissions with reference to the reply affidavit filed by the respondent No.2. He submits that the notice dated 29.9.2021 (signed on 30.9.2021) was issued in a different context, more particularly in view of certain complaints made to the respondent No.1. He also submits that there is no cause of action for the petitioner for filing the present Contempt Case and urges for dismissal of the same.

At the outset, it may be appropriate to note that the writ petition is still pending and keeping in view the limited jurisdiction under the Contempt of Courts Act and more particularly in the light of the specific averments made in paragraph No.7 of the reply affidavit, which is extracted hereunder, the Contempt Case is closed. However, the petitioner is at liberty to seek recourse to law in the event any fresh cause of action arises.

7) I humbly submit that I have not disobeyed Hon'ble court interim order issued in W.P. No.16639/2020 Dated 07-09-2020 at any time and not trying to disposes the petitioner from the land in Sy. No. 1240/10 ext. 1-00 Acs of Jangamraju palli village of B. Mattam Mandal. There is no any proposal to acquire the land, and also assign the land to others. It is only the fear of petitioner against suit filed by the Respondent No: 5 in local court. This respondent was issued a notice on 30-09-2021 only to ascertain facts regarding title right over the land in question and due process of law have been followed.

There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
