AMARAVATI, India, Feb. 22 -- Andhra Pradesh High Court issued the following order on Jan. 20:

1. These appeals have been filed by the appellants, aggrieved by the common judgment and decree dated 06.01.2003 passed in O.S. No. 143 of 1984 and O.S. No. 164 of 1984 by the learned Senior Civil Judge, Anakapalli. O.S.No.143 of 1984 i.e., the suit for rendition of accounts was dismissed. O.S.No.164 of 1984 i.e., the suit for recovery of amount filed by the plaintiff-Bank was decreed.

2. Sri M. Bala Subrahmanyam, learned counsel for the appellants, appearing through virtual mode, submits that the sole appellant has died and that the appeals have abated and be dismissed as such.

3. On perusal of the record, we find that both the appeals were filed by more than one appellant, and when confronted, learned counsel insisted "sole appellant" and on our request to see the array of parties, he submits that he is not having the records of the appeals with him.

4. Counsels statement carry weight and is required to be made with responsibility. Appearance is through virtual mode and without file.

5. The matters have not been argued. The Appeal Suits are dismissed "for want of prosecution".

No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.
