ANDHRA PRADESH HIGH COURT ISSUES ORDER FOR BODDU SRI REVATHI V/S B GANGA BHAVANI AND ANR.

AMARAVATI, India, March 8 -- Andhra Pradesh High Court issued the following order on Feb. 5:

1. The above contempt case was filed complaining of a violation of the order dated 14.08.2024, passed in W.P.No.17798 of 2024.

2. Heard learned counsel appearing on both sides.

3. The petitioner filed the aforementioned writ petition complaining that the respondents 4 & 5 i.e. the Mandal Parishad Development Officer and the Assistant Project Officer, are preventing the petitioner from performing her duties as Field Assistant in Dharmavaram Village, Dagadarthi Mandal, SPSR Nellore District.

4. The writ petition was disposed of on 14.08.2024. The operative portion of said order reads as follows:

"Given the fact and circumstances of the case, coupled with the instructions of learned Standing Counsel, the Writ Petition is disposed of at the stage of admission with the consent of both the counsels, directing the respondents 3 to 5 not to obstruct the petitioner in discharging duties as Field Assistant in Dharmavaram Village, Dharmavaram Panchayat, Dagadarthi Mandal, SPSR Nellore District without following due process. There shall be no order as to costs."

5. The contempt case was filed on 05.02.2025.

6. In the affidavit filed in support of the contempt case, it was pleaded that respondent has violated the order dated 14.08.2024.

7. Today, when the matter is taken up for consideration, it is brought to the notice of this Court that in pursuance of the order passed by this Court, the petitioner joined the duty on 28.11.2024. The Mandal Parishad Development Officer informed the same to the Project Director by a letter dated 30.11.2024.

8. Though learned counsel for the petitioner contends that respondent is not permitting the petitioner to discharge her duties as Field Assistant despite the letter dated 30.11.2024, no material has been placed before this Court to substantiate the said contention.

. Thus, in the absence of any material, this Court does not find any violation of the order dated 14.08.2024, passed in W.P.No.17798 of 2024.

10. Given the facts and circumstances of the case, the Contempt Case is dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
